Driving Under the Influence refers to those that are driving a motorized vehicle when the driver’s Blood Alcohol Content is above the limit legalized in that particular state. No matter what the legal limit is in any state, you must be above the legalized drinking age or the legal Blood Alcohol Content is .00%. However, when you are above the legalized drinking age, which in Washington DC is 21, your Blood Alcohol Content may be .08%. Commercial vehicle drivers including limousine drivers, taxi drivers, bus drivers, or truck drivers must stay at .04%. These DUI laws in Washington DC have been greatly strengthened due to the high levels of deaths caused by drunk drivers in this area.

Penalties for DUI Offenders

  • Minimum: Penalties for first time offenders of crossing DUI limits have been amplified. 5 days of jail time is MINIMALLY required for those whose Blood Alcohol Content is .20% or higher. This has caused a huge rise in DUI charges in DC. Minimum for second time offenders will serve 5 days of jail time or 30 days of community service will be required. 3rd time offenders will receive a minimum of 10 days jail or 60 days of community service.

    • 1 year maximum jail time
    • $2,000 to $10,000 fine payment
    • 2 year license suspension
